Types of road traffic accident injury claims
Liddy’s Solicitors have successfully handled many different types of road traffic accident compensation claims, including:
- Whiplash
- Fatal accidents
- Brain and spinal injuries
- Car crashes
- Injuries suffered by passengers
- Motorcycle accidents
- Cycling accident injuries
- Public transport accidents
- Taxi crashes
- Commercial vehicle accidents (lorries and vans)
- Pedestrian injuries
- Accidents involving the emergency services
The majority of road traffic accident injury claims are made against the insurance company of the person responsible for the incident. Depending on the exact circumstances of the accident, that may be the driver of the vehicle you were travelling in, a third-party driver or, in some cases, both.
However, it is not always possible to make a claim against an insurer. This may be because:
- The driver at fault was not insured
- The driver at fault was in a stolen vehicle
- The driver who caused the accident did not stop and cannot be traced
Our specialist personal injury solicitors have successfully handled many claims like this and have developed considerable expertise in Uninsured Loss Recovery. If you have been injured or your property has been damaged due to the negligence of an uninsured or untraced driver, we can help you to claim the compensation to which you are entitled via the Motor Insurers’ Bureau.
How to make a road traffic accident injury claim
If you have been hurt in a road traffic accident caused by someone else’s negligence, you are entitled to claim compensation for your injuries, the cost of private medical treatment and any financial losses, such as having to take time off work.
In order for your claim to succeed you will need to prove that someone else – typically either a third-party driver or the driver of the vehicle you were travelling in – was responsible for your injuries.
A good starting point for this is to take the names and contact details of any witnesses to the accident, and to take photographs of the scene. If the incident is serious, the other party leaves the scene without exchanging contact details or admits to not having valid insurance, you should also report the matter to the police.
It is not always possible to do this at the time of the accident, perhaps because you were badly injured or suffering from shock. However, that does not mean you will not be able to make a personal injury claim.
Liddy’s Solicitors have vast experience of handling road traffic accident claims and can help you to compile the evidence you need to prove who was at fault. At the same time, we will ensure you undergo the medical assessments needed to demonstrate the severity of your injuries and advise you how to document any treatment costs and financial losses incurred.
In addition to establishing liability, one of our solicitors will guide you through every stage of the claims process. From initial consultation through to negotiating a financial settlement or issuing Court proceedings, you will receive the best possible advice.
