Administrative Error Leads to Suffering and Delayed Surgery

We were consulted by the family of a man who died aged 86. He suffered from COPD and Heart Failure and had right hip pain. He was on a waiting list for a total hip replacement. Due to an administrative error at the trust, he was never sent a return appointment. He never received an appointment for the operation and died 2 ½ years later, having lived the rest of his life with deteriorating mobility and in discomfort throughout.
Liability was not admitted by the Defendant, but they made a settlement offer of £5,000 on 19.01.2024 which was accepted by the Claimant.
